ベンダー行動規範の目的とお願い

シマノグループ(*1)は、その行動規範において、世界各国・各地域の適用される法令を遵守し、誠実で公正な行動に努めることを方針としています。また、国際的に認められた人権と各国法との間に矛盾がある場合においては、各国法を遵守しつつ国際的な人権規範を尊重するための方法を追求します。

シマノグループは、サプライヤーに対して、法令遵守、誠実で公正な行動及び国際的な人権規範の尊重に努めることを期待しています。
シマノグループは、所属している世界スポーツ用品工業連盟(WFSGI)の行動規範が、国際的に認められた人権・環境等の規範に依拠し、かつスポーツ用品を扱う企業として実践するべき水準を明記していることから、これをシマノグループのサプライヤーが社会及び環境に対する責任を果たすための規範として、適切なものであると考え、別紙に示す「WFSGI Code Of Conduct」を、シマノグループのサプライヤーを対象とする行動規範(以下、「ベンダー行動規範」とします。)として適用するものとします。
シマノグループは、全てのサプライヤー及びサプライヤーのサプライチェーンに対して、ベンダー行動規範への理解、賛同及び実践を要望します。

ベンダー行動規範がシマノグループのサプライヤーに適用される際には、WFSGI Code Of Conductの「メンバー会社」はシマノグループを、「サプライヤー」はシマノグループの調達先を意味するものとします。
また、世界各国・各地域で適用される法令が要求する水準とベンダー行動規範が要求する水準のいずれかより厳しい方が採用されるものとします。

<言語>
WFSGI Code Of Conduct 及びベンダー行動規範の英語版を正本とみなします。必要に応じて、日本語版等の仮訳を作成します。英語版と多言語版の間に矛盾抵触がある場合、英語版が優先するものとします。

<制定と改廃>
ベンダー行動規範の制定と改廃は、株式会社シマノ内の適切な手続きに基づいて行われるものとします。なお、WFSGIによりWFSGI Code Of Conductが改定された場合には、都度、改定内容について評価し、当社における手続きを踏んだ上、改定後のWFSGI Code Of Conductをベンダー行動規範として適用するものとします。

I. LEGAL COMPLIANCE

Member companies and their suppliers are expected to operate in full compliance with relevant local, national and international laws, standards, rules and regulations applicable to their business operations including but not limited to employment, the fundamental principles and rights at work, environmental protection, health and safety, ethical business conduct, consumer protection and product safety. Where differences or conflicts arise between this Code and applicable national or international laws or standards, members and their suppliers are expected to apply the higher standard consistent with the UNGPs and OECD Guidelines.

Members and their suppliers shall maintain appropriate visibility, to the extent feasible, over subcontractors involved in the production process and require subcontractors to meet the same standards of compliance as set out in this Code. (*2)

1. Business Integrity: Anti-Corruption, Bribery & Ethics

Members and their suppliers shall conduct business with integrity, transparency, and fairness. Any form of corruption, bribery, extortion, or embezzlement is strictly prohibited. This includes but is not limited to offering or accepting anything of value to influence decisions or gain improper advantage, misuse of company resources and confidential information, money laundering, conflict of interest and anti-competitive practices. Companies must have clear policies and procedures in place to prevent, detect and respond to unethical behaviour.

2. Data Protection & Information Security

Members and suppliers shall implement appropriate measures to protect personal data and confidential information. This includes compliance with applicable data protection and cyber security laws and ensuring secure handling, storage, and transmission of sensitive information.

II. WORKING CONDITIONS

Employers shall implement risk-based human rights and environmental due diligence consistent with the UNGPs and OECD Guidelines, including risk assessments, integration of actions, tracking, communication, and enable access to remedy where appropriate, with attention to salient risks and vulnerable groups. Local industry standards should prevail when higher than the local legal requirements. In countries where the legal requirements fall short of internationally recognised standards, it is recommended that members should apply the following criteria:

3. Management Systems

Employers shall establish and maintain appropriate management systems to ensure adherence to the principles covered in this Code. These systems shall include but are not limited to:

Clear policies and procedures;
Regular training for relevant personnel;
Documentation and record-keeping;

Maintaining systems that ensure accountability and continuous improvement including mechanisms for internal reporting and corrective action.

Members and suppliers should consider the impact of their purchasing and production planning practices on working conditions, including wages, working hours, and employment stability. These systems should support ongoing human rights and environmental due diligence.

4. Child Labour

No person shall be employed directly or through business partners at an age younger than 15 unless under the exceptions recognised by the ILO, or below the age for completing compulsory education. Any legally permitted exceptions under international standards must not interfere with compulsory education or expose the child to risk. Employers shall establish and maintain robust, non-intrusive age verification mechanisms as part of the recruitment process, which may not degrade or disrespect the worker in any way.

Where underage employment is discovered, remediation measures must prioritise the best interest of the child and align with recognised good practice (e.g. education continuity and appropriate income support for families), with special care to protect workers under 18 during any transition.

5. Protection of Young Employees

All legal protections for employees under 18 shall be upheld and no person under the age of 18 shall be engaged in hazardous work or conditions, or night work, or any tasks likely to jeopardize their health, safety, or morals, as defined by the ILO. Employers and their business partners shall ensure that employment does not cause insecurity or social or economic vulnerability for the under 18 employee. Young workers shall be provided with a documented and recognised employment agreement in a language they understand using whichever national or international standard affords the greatest protection.

Special care and consideration must be given to the working hours of young workers, in accordance with laws and international guidelines. Special care will also be taken to identify measures in a proactive manner in cases of dismissal and removal of under 18s to ensure the protection of these young employees.

6. Forced or Bonded Labour and Human Trafficking

Employers and their suppliers shall not engage in any form of forced, bonded, indentured, or prison labour, nor in any other form of coercion or human trafficking.

Employees must be engaged voluntarily and have the right to terminate their employment freely, with reasonable notice, in accordance with applicable laws and regulations.

Employers and their suppliers shall implement the principles of responsible recruitment, ensuring that:

No employees pay any fees to obtain or maintain their jobs. All recruitment fees and related costs must be borne by the employer, not the worker.
Workers retain possession and control of their personal documents, including passports and identity papers.
Workers receive a timely refund of fees that they have paid to obtain or maintain their jobs.
Workers have full freedom of movement, both during and outside working hours, subject only to reasonable, proportionate, and lawful restrictions related to safety, security, or residential arrangements, and without coercion or penalty.
Employment terms and conditions are communicated clearly, in a language that workers understand, prior to departure from their home country or region.
Any employment must not involve deception, withholding of wages, intimidation, threats, or abuse of legal or immigration processes.

7. Non-Discrimination

All employees shall be treated with dignity, fairness and respect. There shall be no discrimination in any employment practice including: recruitment, compensation, access to training, promotion, discipline, termination, or retirement, on the basis of but not limited to: race, colour, ethnicity, social group, nationality, caste, gender, gender identity or expression, age, religion or belief, disability, sexual orientation, political affiliation or opinion, marital or parental status, caregiver responsibilities, pregnancy, health conditions (including HIV status), neurodiversity, or any other status protected by applicable law.

Foreign or domestic migrant workers shall receive equal treatment and protections in line with local workers in similar roles and conditions.

8. Disciplinary Measures

Employers shall prohibit any form of corporal punishment, physical or mental coercion, verbal abuse, violence, humiliation, or other inhumane or degrading treatment either by management or other workers.

All disciplinary measures must be fair, lawful, and non-discriminatory, clearly defined and communicated to workers in a language they understand, be consistently applied and appropriately documented. Employees must have the right to respond or appeal through an accessible, transparent, and confidential grievance mechanism and be carried out without any threat of retaliation for filing a complaint.

Employers must maintain systems that ensure accountability, due process, and continuous improvement in protecting the rights and dignity of all workers.

9. Freedom of Association and Collective Bargaining

Employers shall respect the rights of all workers to freely join or not, organisations and associations of their choice and to bargain collectively without penalty, retaliation or interference. Their right to bargain collectively shall be recognised and respected. Where these rights are restricted by law, employers must not obstruct or interfere in employees’ efforts to establish independent and representative forms of worker organisation and dialogue consistent with international standards.

Employers shall encourage meaningful and inclusive representation of all workers and engage with chosen representatives regardless of their gender, role or employment status. Where workers are represented by trade unions or other legitimate worker representatives, employers shall allow reasonable access to the workplace for the purpose of carrying out representative functions, in line with applicable laws and agreements.

10. Wages and Benefits.

Employees shall receive compensation regularly and in a timely manner, and in legal tender. All partial or “in-kind” payments or allowances will only be concluded if in line with ILO specifications. Equal remuneration for men and women employees for work of equal value shall be upheld. No deductions will be permitted unless legally required or contractually agreed upon as part of a collective bargaining agreement. All employees will be granted their statutory and mandated legal social benefits that their position and seniority is owed without negative impact on the salary. Overtime hours shall be compensated at a premium rate in line with national laws.

Members should aspire to progressive improvements in wages in line with international best practices. Employers shall pay at least the minimum or prevailing industry wage, whichever is higher, and comply with all legal requirements on wages and benefits. Where wages do not yet meet workers’ basic needs, employers should work toward the progressive realisation of a living wage in line with recognised benchmarks.

11. Working Hours

Employees shall not be required to work in excess of 48 regular hours per week, or the local legal requirement, whichever is more stringent. Overtime work must be voluntary and paid at a premium and not be required on a regular basis. The sum of regular and overtime hours in a week must not exceed 60 hours unless in exceptional or extraordinary circumstances. Employees shall receive adequate resting breaks during the working day and be entitled to at least 24 consecutive hours of rest within every 7 day period. National legal requirements, industry standards or collective agreements within international frameworks set out by the ILO will be complied with to promote a healthy work-life balance for employees.

12. Regular Employment and Worker Involvement

Employees shall be employed under a recognised and documented employment relationship or legally recognised engagement agreement established in accordance with national labour and social security laws, international labour standards or industry best practices.

Employers shall ensure that recruitment and employment relationships must not cause insecurity, economic vulnerability, or social vulnerability. Employees must receive a written offer or written agreement in a language they understand, before commencing. This document must include:

Rights & responsibilities
Working hours
Wages and payment terms
Entitlements to statutory benefits and protections.

Employers must not use temporary contracts, subcontracting, or apprenticeship schemes to avoid legal obligations or undermine worker rights. All employment arrangements must reflect genuine work purposes and not be used to evade legal obligations. Employees, particularly those from vulnerable groups (e.g. migrant workers, women, young workers), must be provided with training on their rights and responsibilities and recruiters, brokers and intermediaries should support and reinforce this training.

13. Health and Safety

Employers shall provide a safe and healthy working environment that complies with all applicable national Occupational Health and Safety (OHS) laws by identifying, assessing and mitigating physical, chemical, and biological hazards and risks. In cases where international OHS standards go beyond local laws, employers are expected to follow the higher recognised international standard. OHS practices must be designed to prevent accidents, injuries, and illnesses arising from, linked to, or occurring during the course of work or resulting from employer operations and facilities. All legally required permits, licenses, insurances, and safety documentation must be in place and regularly updated.

Employers are responsible for the following:

Risk Assessments & Prevention: employers shall establish proactive systems to identify, assess, prevent, and mitigate health and safety risks, including foreseeable emergencies.
Protection for Vulnerable Workers: Special provisions must be in place for expecting and nursing mothers, young workers (under 18), and persons with disabilities. This includes tailored work assignments, adjusted conditions and personal protective equipment (PPE) suited to their needs.
Occupational Health & Safety Training: Employees must receive regular OHS training throughout their employment, with additional training for high-risk roles and to workers newly assigned to such roles.
Fire Safety & Emergency Preparedness: Employers must take effective measures to minimise hazards and ensure preparedness for fire, chemical exposure, and other emergencies.
Personal Protective Equipment (PPE): PPE must be provided free of charge, be appropriate for the risk level, and meet international safety standards.
Hygiene & Sanitation: Employers must ensure the availability of:

Safe and clean drinking water free of charge.
-
Adequate rest areas, eating facilities, and food storage options where applicable.
-
Private and secure toilet facilities for all genders with washbasins and running water, soap and towels.
Worker Participation: Employers must establish an Occupational Health & Safety Committee or other appropriate worker participation mechanism to ensure that workers and their representatives are consulted and encouraged to participate actively in all elements of the OSH management system. This committee should meet regularly and play a role in monitoring, reviewing, and improving workplace safety.
Medical Assistance & Compensation: Employers must provide access to occupational medical care and ensure that workers are covered by appropriate insurance for injuries and illnesses resulting from work.

All employees have the right to refuse unsafe work. Employees have the right to exit the premises and/or stop working without permission in dangerous situations or uncontrolled hazards, provided they have fulfilled their obligation to inform the employer or supervisor of the hazards and imminent danger where possible. All standards shall apply to employee residential facilities, where provided by the employer.

14. Harassment or Abuse

Every employee has the right to be treated with respect and dignity and to work in an environment that is free from harassment, abuse, and any form of inhumane or degrading treatment. Employers shall prohibit all forms of physical, sexual, psychological, and verbal harassment or abuse, whether committed by supervisors, colleagues, security forces or third parties. This includes unwelcome behaviour, threats, intimidation, bullying, and exploitation in any form. Prompt, fair, and effective action must be taken when violations occur. Disciplinary actions must be appropriate, consistent, and aligned with national legal frameworks.

15. Grievance Mechanism & Whistleblower Protection

Employers must establish or participate in effective operational-level grievance mechanisms that are safe, confidential, accessible and comply with international guidelines enabling employees and stakeholders to report concerns or violations of this Code. Whistleblowers shall be protected from any form of retaliation, including dismissal, demotion, harassment, or other adverse impacts. Allegations must be treated seriously and investigated promptly, fairly, and transparently, with appropriate remediation where necessary.

III. ENVIRONMENT

Members and their suppliers must comply with all applicable environmental laws and regulations. Beyond compliance, members and suppliers are encouraged to take measurable steps to reduce their environmental impact and implement responsible business practices. This includes:

Implement an environmental management system that identifies, assesses, prevents, and mitigates significant environmental risks and impacts, where feasible.
Business integration: embed environmental considerations into business decisions, policies, and operational planning.
Resource Use: use resources such as energy, water and raw materials responsibly, aiming at reducing consumption and improving efficiency.
Pollution and Waste Reduction: minimize pollution, emissions, waste and hazardous substances generation (including solid, liquid, and gaseous emissions), through enhanced operational controls, waste reduction initiatives, and improved production processes in accordance with applicable environmental safety standards.
Transparency: are encouraged to track, document, and disclose upon request environmental performance and improvements.

Members and suppliers are also encouraged to set and pursue clear, measurable management approaches or ambitions, which may include:

Renewable energy: transition to renewable energy where feasible and set milestones for implementation.
Carbon footprint reduction (GHG emissions): establish measurable goals and take active steps to measure, report, and reduce their emissions.
Water conservation and responsible wastewater management: adopt practices that promote water conservation and ensure responsible wastewater management.
Zero-Waste Goals: work toward zero-waste-to-landfill through prevention, reuse, and recycling practices.
Circularity Metrics: track progress in circularity, such as material recovery rates, product reuse, or closed-loop initiatives.

Members and suppliers are encouraged to demonstrate leadership through active participation in initiatives that drive broader environmental progress across the industry.

IV. COMMUNITY INVOLVEMENT

Members and their suppliers recognise the economic and social impact of their work and should engage meaningfully with affected communities. Where activities affect land, water, or resource use, they should identify and address potential adverse impacts through due diligence and engagement processes consistent with international standards, with particular attention to the rights of Indigenous peoples and local communities.

V. COMPANY SPECIFIC STANDARDS

Members are encouraged to draw up their own specific code of ethical conduct, if they have not already done so, building on the above standards.

VI. VERIFICATION & COMPLIANCE

These Principles are intended to provide guidance for members and suppliers to ensure their business operates responsibly. Members are expected to take reasonable steps, consistent with applicable law, to align their own operations and supply chains with these principles. WFSGI does not audit, certify, independently verify, or enforce members’ compliance with this Code and assumes no duty to monitor or investigate member conduct. Any information shared by members regarding implementation of the Code is provided on a self-reported basis, and WFSGI may rely on such information without verification. WFSGI may seek clarification from members, signposting the relevant statutory guidance or regulators. WFSGI may, from time to time, invite members to share high-level information about their implementation efforts for learning, benchmarking, or dialogue purposes. Such engagement does not constitute oversight, approval, or endorsement of member practices by WFSGI.

The Shimano Group requires its suppliers to understand, agree to, and implement the following:
The suppliers shall assess the compliance of their supply chains with each principle, and correct any problems on a continuous basis.

I. 法令遵守

メンバーおよびそのサプライヤーは、雇用、労働における基本的原則と権利、環境保護、安全衛生、倫理的な事業活動、消費者保護、製品安全を含む(ただしこれらに限定されない)、事業運営に適用される現地および国内外の法律、基準、規則、規制を完全に遵守して事業を行うことを求められています。適用される国内外の法律または基準と本規範との間に相違や矛盾が生じた場合、メンバーおよびそのサプライヤーは、UNGPs およびOECD指針に準拠した、より高い基準を適用することを求められます。

メンバーおよびそのサプライヤーは、実行可能な範囲で、生産プロセスに関与する下請業者について適切な可視性を維持し、本規範に定めるものと同等の遵守基準を満たすよう下請業者に要求するものとします。 (*2)

1. ビジネスにおける誠実さ:汚職防止、贈収賄防止、および倫理

メンバーおよびそのサプライヤーは、誠実さ、透明性、公正さを持って事業を行うものとします。あらゆる形態の汚職、贈収賄、恐喝、横領は固く禁じられています。これには、意思決定に影響を与えたり、不適切な利益を得たりすることを意図した価値あるものの授受、会社のリソースおよび機密情報の不正利用、マネーロンダリング、利益相反、反競争的慣行が含まれますが、これらに限定されません。企業は、非倫理的な行動を防止、検知し、これに対応するための明確な方針と手順を整備しなければなりません。

2. データ保護および情報セキュリティ

メンバーおよびそのサプライヤーは、個人データと機密情報を保護するために適切な措置を講じるものとします。これには、適用されるデータ保護法およびサイバーセキュリティ法の遵守、ならびに機微情報の安全な取り扱い、保管、送信の確保が含まれます。

II. 労働条件

雇用主は、UNGPsおよびOECD指針に従い、顕著なリスクと脆弱なグループに注意を払いつつ、リスクベースの人権・環境デューデリジェンスを実施するものとします。かかるデューデリジェンスには、リスク評価、対策の統合、追跡、伝達、および該当する場合は救済措置へのアクセス提供が含まれます。現地の業界基準が現地の法的要件よりも厳しい場合は、前者を優先するものとします。法的要件が国際的に認められた基準に満たない国では、メンバーには以下の基準を適用することを推奨します。

3. マネジメントシステム

雇用主は、本規範に定める原則の遵守を確保するため、適切なマネジメントシステムを確立し、維持するものとします。これらのシステムには以下の要素が含まれますが、これらに限定されません。

明確な方針と手順
関係要員を対象とした定期的な研修
文書化と記録保持

内部報告および是正措置のためのメカニズムを含む、説明責任と継続的改善を確保するシステムの維持。
メンバーおよびそのサプライヤーは、自社の購買・生産計画の実践が、賃金、労働時間、雇用の安定などの労働条件に与える影響を考慮する必要があります。これらのシステムは、継続的な人権/環境デューデリジェンスをサポートするものでなければなりません。

4. 児童労働

ILOが認める例外に該当する場合を除き、15歳未満または義務教育を修了する年齢に満たない者を、直接またはビジネスパートナーを通じて雇用してはなりません。国際基準の下で法的に認められるいかなる例外も、義務教育を妨げたり、子供を危険にさらしたりするものであってはなりません。雇用主は、採用プロセスの一環として、いかなる形においても労働者の品位を傷つけたり、労働者を軽んじたりすることのない、堅牢で過度に干渉しない年齢確認の仕組みを確立し、維持するものとします。

未成年者の雇用が発覚した場合の是正措置は、子供の最善の利益を優先し、認められたグッドプラクティス(例:教育の継続、家族への適切な所得支援)に沿ったものでなければならず、いかなる移行期間であろうと18歳未満の労働者を保護するための特別な配慮が必要です。

5. 若年従業員の保護

18 歳未満の従業員に対するすべての法的保護を遵守するものとし、ILOの定義による危険な作業や状況、夜間作業、または健康、安全、道徳を危険にさらす可能性がある業務に、18 歳未満の者を従事させてはなりません。雇用主とそのビジネスパートナーは、18 歳未満の従業員について、雇用により不安定さや社会的・経済的脆弱性が生じないよう徹底するものとします。若年労働者には、国内外の基準のうち最も手厚い保護を与えるものを適用し、若年労働者が理解できる言語で文書化され、相互に合意した雇用契約を提供しなければなりません。

法律および国際的なガイドラインに従い、若年労働者の労働時間には特別な注意と配慮を払う必要があります。また、18 歳未満の者を解雇・解職する場合に備え、特別な配慮をもって、かかる若年従業員を確実に保護する措置を能動的に講じます。

6. 強制労働、債務労働、および人身取引

雇用主およびそのサプライヤーは、あらゆる形態の強制労働、債務労働、年季契約労働、囚人労働に加え、その他あらゆる形態の強迫や人身売買に関与してはなりません。

従業員は、自由意志によって雇用されていなければならず、適用される法令に従い、合理的な通知をもって自由に退職する権利を有します。

雇用主およびそのサプライヤーは、以下を徹底し、責任ある採用の原則を実施するものとします。

従業員から採用手数料または雇用維持手数料を徴収しないこと。すべての採用手数料および関連費用は必ず、労働者ではなく雇用主が負担すること。
労働者自身がパスポートや身分証明書などの個人書類を所持し、管理すること。
労働者が支払った採用手数料または雇用維持手数料を、速やかに労働者に払い戻すこと。
労働者は、勤務時間中および勤務時間外の両方において、安全性、セキュリティ、または住居に関する合理的かつ相応で合法的な制限のみに従い、強迫や罰則なく移動できる完全な自由を有します。
雇用条件は、労働者が母国または出身地域を出発する前に、労働者が理解できる言語で明確に伝えます。
いかなる雇用においても、欺瞞、賃金の不払い、脅迫、威嚇、または法的手続や出入国管理手続の悪用があってはなりません。

7. 差別禁止

すべての従業員は、尊厳、公正さ、敬意を持って扱われるものとします。いかなる雇用慣行(採用、報酬、研修へのアクセス、昇進、懲戒、解雇、退職を含む)においても、人種、肌の色、民族、社会集団、国籍、カースト、ジェンダー、性自認または性表現、年齢、宗教または信条、障がい、性的指向、支持政党または政治的見解、婚姻・親権状況、介護責任、妊娠、健康状態(HIV 感染を含む)、神経多様性、その他適用法で保護される特性などに基づく(ただしこれらに限定されない)差別は禁じられています。

外国人労働者または国内移住労働者は、同様の役割・条件で働く現地の労働者と同等の待遇および保護を受けるものとします。

8. 懲戒処分

雇用主は、経営陣または他の労働者による、あらゆる形態の体罰、身体的または精神的な強迫、言葉による虐待、暴力、侮辱、その他の非人道的扱いまたは品位を傷つける扱いを禁止するものとします。 すべての懲戒処分は、公正、合法かつ非差別的でなければならず、労働者が理解できる言語で明確に定義および伝達され、一貫性を持って適用され、適切に文書化されなければなりません。従業員は、利用しやすく透明性があり、機密性が保たれた苦情処理メカニズムを通じて回答または異議申し立てを行う権利を有し、苦情申し立てに対する報復を受けるおそれなく申し立てを実行できなければなりません。

雇用主は、すべての労働者の権利と尊厳を保護するための説明責任、適正手続き、継続的な改善を確保するシステムを維持しなければなりません。

9. 結社の自由および団体交渉

雇用主は、すべての労働者が有する、罰則、報復、干渉を受けることなく自ら選択する組織や団体に自由に加入する権利または加入しない権利、および団体交渉を行う権利を尊重するものとします。団体交渉を行う労働者の権利は、認められ尊重されるべきものです。これらの権利が法律によって制限されている場合、国際基準の下で独立した代表制の労働者組織および対話を確立しようとする従業員の試みを、雇用主が妨害したり、干渉したりすることは禁じられています。

雇用主は、すべての労働者の有意義で包括的な代表制を奨励し、ジェンダー、役割、雇用形態を問わず、選出された代表者と対話するものとします。労働組合またはその他の正当な労働者代表が労働者を代表している場合、雇用主は、適用される法律および協定に従い、職務を遂行するために代表が必要とする職場への合理的なアクセスを許可するものとします。

10. 賃金および福利厚生

従業員は、定期的かつ適時に、法定通貨で報酬を受け取るものとします。すべての部分的な支払いや手当、または「現物」による支払いや手当は、ILOの規定に沿っている場合にのみ行われます。同一価値労働に対する男女従業員の同一賃金を確保しなければなりません。法律で義務付けられているか、労働協約の一部として契約上合意されている場合を除き、いかなる控除も許可されません。すべての従業員に対し、給与に悪影響を与えることなく、その地位と勤続年数に応じて法定かつ必須の社会保障給付が支給されます。時間外手当は、国内法に定める割増率に基づいて支給されるものとします。

メンバーは、国際的なベストプラクティスに従って、段階的な賃金改善を目指す必要があります。雇用主は、少なくとも最低賃金または業界平均賃金のいずれか高い方を支払い、賃金および福利厚生に関するすべての法的要件を遵守するものとします。賃金が労働者の基本的ニーズを満たしていない場合、雇用主は、認められたベンチマークに従って生活賃金の段階的な実現に取り組む必要があります。

11. 労働時間

従業員に対し、週48時間の所定労働時間または現地の法的要件のいずれか厳しい方を超過した勤務を義務付けてはなりません。時間外労働は自主的でなければならず、割増賃金が支払われるものとし、日常的に要求してはなりません。例外的状況または特別な状況にある場合を除き、1週間の所定労働時間と時間外労働時間の合計が60時間を超えてはなりません。従業員は、勤務時間中に適切な休憩時間を取り、7日ごとに少なくとも連続24時間の休息を得る権利を有するものとします。従業員の健全なワークライフバランスを促進するため、ILOが定めた国際的な枠組みの下で国内の法的要件、業界基準、または労働協約を遵守します。

12. 正規雇用および労働者の関与

従業員は、国内の労働法および社会保障法、国際労働基準、または業界のベストプラクティスに従って確立された、相互に合意し文書化された雇用関係、または法的に認められた契約の下で雇用されなければなりません。

雇用主は、採用および雇用関係により、不安定さや経済的・社会的脆弱性が生じないよう徹底するものとします。内定通知書または雇用契約書については、従業員が理解できる言語で作成したものを勤務開始前に提供しなければなりません。この文書には、以下を記載するものとします。

労働時間
賃金および支払条件
法定福利厚生および保護を受ける権利

雇用主は、法的義務の回避や労働者の権利を損なうことを目的として有期契約、下請け、または見習い制度を利用することを禁じられています。すべての雇用形態は、真の業務目的に適うものでなければならず、法的義務を回避するために利用されてはなりません。従業員、特に社会的弱者(移民労働者、女性、若年労働者など)に属する従業員に対しては、その権利と責任に関する研修を実施しなければならず、採用担当者、ブローカー、仲介業者はこの研修を支援し、強化する必要があります。

13. 安全衛生

雇用主は、物理的、化学的、生物学的な危険とリスクの特定、評価、軽減を通じて、国内の適用されるすべての労働安全衛生(OHS)法に準拠した安全で衛生的な労働環境を提供しなければなりません。国際的なOHS 基準が国内法を上回る場合、雇用主は、より高い水準として認められている国際基準に従うことを求められます。OHS 慣行は、業務に起因または関連する、業務中に発生する、もしくは雇用主の事業運営および施設を原因とする事故、負傷、疾病を防止するために策定しなければなりません。法的に義務付けられるすべての許可、免許、保険、および安全に関する文書を取得・整備し、定期的に更新する必要があります。

雇用主は、以下について責任を負います。

リスク評価および予防:雇用主は、予見可能な緊急事態を含め、安全衛生上のリスクを特定、評価、予防、軽減するための事前対応型システムを確立するものとします。
脆弱な労働者の保護:妊娠中・授乳中の母親、若年労働者(18 歳未満)、および障がいのある人を対象とした特別な規定を定める必要があります。これには、個々のニーズに合わせた業務の割り当て、労働条件の調整、およびニーズに適した個人用保護具(PPE)の支給が含まれます。
労働安全衛生研修:従業員は、雇用期間を通じて定期的な OHS 研修を受ける必要があり、高リスクの職務およびかかる職務に新たに配属された労働者には追加の研修を提供しなければなりません。
防火および緊急時対応:雇用主は、危険を最小限に抑え、火災、化学物質への暴露、その他の緊急事態への事前準備を徹底するため、効果的な措置を講じる必要があります。
個人用保護具(PPE):リスクレベルに応じて、国際的な安全基準を満たしたPPEを無償で提供しなければなりません。
衛生習慣および公衆衛生設備:雇用主は、以下が利用可能であるよう徹底しなければなりません。

労働者の参画:雇用主は、労働者とその代表者の意見を求め、OSHマネジメントシステムの全側面への労働者の積極的な参加を奨励するため、労働安全衛生委員会またはその他の適切な労働者参画の仕組みを確立しなければなりません。この委員会は定期的に会合を行い、職場の安全の監視、レビュー、改善において積極的な役割を担う必要があります。
医療支援および補償:雇用主は、労働者に産業医療へのアクセスを提供し、業務に起因する負傷や疾病を補償する適切な保険に加入させなければなりません。

すべての従業員は、危険な作業を拒否する権利を有します。従業員は、危険な状況や制御不能な危険がある場合、可能な範囲で雇用主または監督者にその危険および差し迫った危険を通知する義務を果たした上で、許可なく施設から退去したり、作業を中止したりする権利を有します。雇用主が従業員に居住施設を提供している場合、すべての基準はかかる居住施設にも適用されるものとします。

14. ハラスメントまたは虐待

すべての従業員は、敬意と尊厳を持って扱われる権利を有し、ハラスメント、虐待、およびあらゆる形態の非人道的扱いまたは品位を傷つける扱いのない環境で働く権利を有します。雇用主は、監督者、同僚、警備員、第三者のいずれが行ったかを問わず、あらゆる形態の身体的、性的、心理的、および言葉によるハラスメントまたは虐待を禁止するものとします。これには、相手を不快にさせる行動、脅迫、威嚇、いじめ、およびあらゆる形態の搾取が含まれます。違反が発生した場合は、迅速、公正かつ効果的な措置を講じる必要があります。懲戒処分は、適切で一貫性があり、かつ国内の法的枠組みに沿ったものでなければなりません。

15. 苦情処理メカニズムおよび内部告発者の保護

雇用主は、従業員および利害関係者が本規範に関する懸念や違反を報告できるよう、国際的なガイドラインに準拠し、安全で機密性が高く利用しやすい、事業所レベルの効果的な苦情処理メカニズムを確立するか、またはそのようなメカニズムに参加しなければなりません。内部告発者は、解雇、降格、ハラスメント、その他の不利益な影響を含む、あらゆる形態の報復から保護されるものとします。申し立ては重要事項として扱われ、迅速、公正かつ透明性を持って調査を受け、必要に応じて適切な是正措置を講じなければなりません。

III. 環境

メンバーおよびそのサプライヤーは、適用されるすべての環境関連法令を遵守しなければなりません。メンバーおよびサプライヤーは、法令遵守だけでなく、環境への影響を緩和し、責任ある事業慣行を実施するための測定可能な措置を講じることが奨励されます。これには以下が含まれます。

実行可能な場合、重大な環境リスクおよび影響を特定、評価、防止、緩和する環境管理システムを導入する。
事業活動への統合:事業上の意思決定、方針、および事業計画に環境への配慮を組み込む。
資源の利用:エネルギー、水、原材料などの資源を責任を持って使用し、消費量の削減と効率の向上を目指す。
汚染と廃棄物の削減:適用される環境安全基準に従い、運用管理体制の強化、廃棄物削減への取り組み、および生産プロセスの改善を通じて、汚染、排出物、廃棄物、有害物質の発生(固体、液体、気体の排出物を含む)を最小限に抑える。
透明性:環境パフォーマンスと改善を追跡および文書化し、要請に応じて開示することが推奨される。

メンバーおよびサプライヤーはまた、以下のような、明確で測定可能な管理アプローチまたは目標を設定し、追求することが奨励されます。

再生可能エネルギー:実現可能な場合は、再生可能エネルギーに切り替え、導入拡大に向けたマイルストーンを設定する。
カーボンフットプリントの削減(GHG 排出量):測定可能な目標を設定し、排出量を測定、報告、削減するための積極的な措置を講じる。
節水と責任ある排水管理:節水を推進し、責任ある排水管理を徹底する慣行を採用する。
ゼロ・ウェイスト目標:ごみを出さない、リユース、リサイクルの慣行を通じて、埋め立て廃棄物ゼロを目指す。
循環性指標:材料回収率、製品の再利用、クローズドループの取り組みなど、循環性の進捗度を追跡する。

メンバーおよびサプライヤーは、業界全体での環境問題解決への取り組みに積極的に参加することにより、リーダーシップを発揮することが奨励されます。

IV. コミュニティへの関与

メンバーおよびそのサプライヤーは、自社の業務の経済的・社会的な影響を認識し、影響を受けるコミュニティとの意味ある関与を深める必要があります。事業活動が土地、水、資源の利用に影響を与える場合、先住民族および地域社会の権利に特に配慮し、国際基準に準拠したデューデリジェンスおよびエンゲージメントプロセスを通じて潜在的な悪影響を特定し、対処しなくてはなりません。

V. 会社固有の基準

メンバーは、上記の基準に基づき、(未策定の場合は)独自の倫理行動規範を策定することが奨励されます。

VI. 検証およびコンプライアンス

これらの原則は、メンバーおよびサプライヤーが責任ある事業運営を徹底するためのガイダンスを提供することを目的としています。メンバーは、適用法を遵守し、自社の事業運営とサプライチェーンをこれらの原則に準拠させるための合理的な措置を講じるよう求められています。WFSGI は、メンバーによる本規範の遵守状況に対する監査、認証、独自検証、強制執行を行わず、メンバーの行動を監視または調査する義務も負いません。本規範の実施状況についてメンバーが提供する情報はすべて自己申告ベースであり、WFSGIは検証を行わずにかかる情報を信頼して取り扱うことができます。WFSGI は、関連する法定の指針や規制機関を示して説明するようメンバーに求める場合があります。WFSGI は随時、学習、ベンチマーキング、意見交換を目的として、メンバーに対し実施状況の概要を求める場合があります。このようなエンゲージメントは、メンバーの慣行に対するWFSGIの監督、承認、支持とはなりません。
